What is meant by right of withdrawal?
The ‘Right of Withdrawal’ represents the consumer’s right to return the purchased goods without having to provide explanations, simply because he has changed his mind, provided that the requirements described below are met.
The ‘right of withdrawal’ is regulated by law and should not be confused with the ‘satisfied or refunded’ commercial policy, which has no legal value but is used for promotional purposes.
To exercise the right of withdrawal pursuant to Legislative Decree no. 206/2005 (Consumer Code), it is necessary to send a registered letter with acknowledgement of receipt to the following address within 10 working days of receiving the products:
Agricultural Company Cantina Divinja by Barbanti Denis – Via Verdeta 1, 41030 Bomporto (MO)
In case of sending by fax or email, it is necessary to confirm the withdrawal with a registered letter within 48 hours to the same address:
Agricultural Company Cantina Divinja by Barbanti Denis – Via Verdeta 1, 41030 Bomporto (MO)
A confirmation will be sent by email or post. The right of withdrawal cannot be exercised only on a part of the purchased product. Furthermore, it is not applicable to purchases made with a VAT number. The return must take place within 10 days of the confirmation sent by the company by email, fax or post.
Return of goods for right of withdrawal
The products must be returned unused, in the original packaging not opened or tampered with, and shipped to: Azienda Agricola Cantina Divinja di Barbanti Denis – Via Verdeta 1, 41030 Bomporto (MO)
If the returned products do not comply with these conditions, the right of withdrawal will be nullified. The products will then be returned to the sender at his expense.
Purpose of processing of collected data
User data is collected to allow the Owner to provide its services, for spam protection, statistics, contact with the user, interactions with social networks and external platforms, comments on content and payment management.
The types of personal data used for each purpose are described in the specific sections of this document.
Refund times in application of the right of withdrawal and competent court
The amount paid, net of additional costs incurred by the company (packaging, shipping costs, reconditioning), will be refunded within 30 days of receipt of the goods. The refund will be made by bank transfer to the coordinates provided by the consumer. The only costs borne by the consumer are those for shipping the returned goods.
For disputes relating to the application of the ‘Right of Withdrawal’, the territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the State.
Complaints, returns, reshipments, cancellations, failure to collect goods, refusal of goods
Any complaints must be forwarded via email or fax. Telephone complaints will not be considered valid. The customer will receive a confirmation of the opening of the complaint within three working days, with instructions for the procedure and any requests for clarification or documentation.
For complaints within six months of delivery, the company will verify the defect at the company premises before granting the remedy provided by the warranty. Defective goods purchased within six months will be replaced.
Shipping costs for the return of defective goods are paid by the customer, while those for reshipment, within six months of purchase, are paid by the company. Shipments in ‘freight collect’ will not be accepted.
The customer can cancel the order within 12 hours of purchase by communicating via email or fax. In case of failure to collect or refusal of the goods, or cancellations beyond the expected terms, the customer will be required to cover the shipping and return costs, with details of the costs provided by the company.
Unless otherwise protected by law, in the event of default by the buyer, the purchase order is considered a legal contract. The company may take legal action to recover expenses incurred.
